California Privacy Rights (CCPA/CPRA)

If you are a California resident, you have certain rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), regarding your personal information.

This California Privacy Rights notice applies to personal information we collect through Malaska Golf websites, applications, subscriptions, purchases, programs, Certified Coach Programs, directories, professional tools, communications, and related services.

Depending on how you interact with Malaska Golf, we may collect the following categories of personal information:

  • professional or employment-related information, if you apply for or participate in a Certified Coach Program or other professional program
  • education, training, or certification-related information, if you apply for or participate in a Certified Coach Program
  • inferences drawn from your activity, preferences, purchases, subscriptions, content engagement, or program participation
  • sensitive personal information, where applicable, such as account login credentials, payment-related information processed by third-party payment providers, or precise information you voluntarily submit through forms or program materials

Certified Coach Program Information

If you apply for, enroll in, participate in, or interact with a Certified Coach Program or other professional program, we may collect and process additional information, including:

  • application information
  • coaching or instructor profile information
  • professional background
  • certification status
  • training progress
  • assessment or testing information
  • renewal status
  • directory listing information
  • biography
  • profile photo
  • location or service area
  • website and social media links
  • student referral or discount code activity
  • student subscription or signup activity associated with your coach code, where applicable
  • program eligibility, benefits, credits, or revenue-related information
  • reviews, ratings, complaints, or feedback related to program participation
  • submitted lesson materials, videos, swing videos, or instructional content

Some Certified Coach Program information may be displayed publicly if you participate in a directory, public profile, listing, testimonial, review, or other public-facing feature.

How We Use Personal Information

We may use personal information to:

  • provide, operate, and maintain the Service
  • create and manage user accounts
  • process purchases, subscriptions, renewals, cancellations, refunds, and payment-related issues
  • deliver purchased content, subscription access, program access, and membership benefits
  • administer the M-System All Access Plan
  • administer Certified Coach Programs and professional access
  • process coach applications, certifications, renewals, and program requirements
  • manage directory listings, coach profiles, badges, credentials, and related professional benefits
  • track student offers, referral activity, coach codes, or related program benefits, where applicable
  • provide customer support
  • send transactional communications
  • send marketing communications where permitted
  • personalize content, offers, communications, or user experience
  • analyze usage, performance, and content engagement
  • improve, maintain, and secure the Service
  • detect, prevent, and address fraud, abuse, unauthorized access, payment disputes, or security issues
  • enforce our Terms of Service, policies, program rules, and legal rights
  • comply with legal, tax, accounting, regulatory, and reporting obligations

  • you directly, when you create an account, purchase content, subscribe, enroll in a program, apply for a Certified Coach Program, submit forms, contact support, or communicate with us
  • your use of the Service, including websites, applications, content libraries, videos, programs, directories, and professional tools
  • payment processors, such as Stripe
  • email, analytics, advertising, hosting, authentication, support, and other service providers
  • coaches, instructors, Producers, Certified Coach Program participants, or professional program administrators, where applicable
  • third-party platforms, such as app stores or other platforms through which you access or purchase the Service
  • publicly available sources, where applicable

Disclosure of Personal Information

We may disclose personal information to:

  • payment processors
  • email service providers
  • analytics providers
  • advertising and marketing platforms
  • hosting, database, website, and application providers
  • authentication and account-management providers
  • customer support tools
  • fulfillment, shipping, or partner vendors, where applicable
  • coaches, instructors, Producers, Certified Coach Program participants, or professional program administrators, where necessary to provide or administer a program, feature, directory, student offer, referral benefit, or professional tool
  • professional advisors, including legal, accounting, compliance, and technical advisors
  • affiliates and related entities
  • government authorities, courts, regulators, or other parties where required or permitted by law
  • successors or potential successors in connection with a merger, acquisition, financing, restructuring, sale of assets, change of control, bankruptcy, or similar transaction

Sale or Sharing of Personal Information

Under California law, “sale” and “sharing” broadly include disclosing personal information to third parties for advertising, analytics, retargeting, or cross-context behavioral advertising purposes.

Malaska Golf does not sell personal information for monetary compensation.

However, we may use third-party services, such as analytics, advertising, retargeting, or campaign measurement platforms, that could be considered a “sale” or “sharing” under California law.

Sensitive Personal Information

We do not use or disclose sensitive personal information for purposes that require a right to limit under California law unless we provide you with the required notice and opportunity to limit such use.

Where sensitive personal information is collected, we use it only as reasonably necessary to provide the Service, process transactions, secure accounts, administer programs, comply with law, prevent fraud, or perform services you requested.

Public Information and Directory Listings

Information you submit to public-facing areas of the Service may be visible to others. This may include comments, reviews, testimonials, profile information, directory listings, coach biographies, profile photos, certification status, location or service area, website links, social media links, ratings, or other public submissions.

If you participate in a Certified Coach Program or directory, certain information may be publicly displayed as part of your listing or professional profile.

Publicly available information and information you intentionally make public may not be subject to the same deletion or opt-out rights in all circumstances.

  • the email address associated with your account
  • the type of request, such as “Access Request,” “Delete Request,” “Correction Request,” or “Do Not Sell or Share”
  • enough information for us to reasonably verify and process your request

We will confirm receipt and respond within the timeframes required by applicable law.

We may need to verify your identity before processing your request. Verification may require matching information you provide with information associated with your account or requesting additional information reasonably necessary to verify your identity.

Deletion Requests

If you request deletion of your personal information, deleting your account or data may result in loss of access to purchased content, subscriptions, programs, Certified Coach Program access, directory listings, professional benefits, and related Service features.

We may retain certain information where permitted or required by law, including information needed to:

  • complete transactions
  • provide goods or services you requested
  • maintain business, tax, accounting, or legal records
  • detect and prevent fraud, abuse, security incidents, or unauthorized activity
  • resolve disputes
  • enforce our Terms of Service, policies, agreements, or program rules
  • comply with legal obligations
  • protect the rights, safety, and security of Malaska Golf, users, instructors, coaches, program participants, or others

Authorized Agents

You may designate an authorized agent to make a request on your behalf.

We may require verification of your identity and the agent’s authority to act on your behalf. This may include written authorization, proof of power of attorney, or other documentation permitted by applicable law.

Non-Discrimination

We will not discriminate against you for exercising any of your privacy rights under California law.

This means we will not deny goods or services, charge a different price, provide a different level or quality of service, or retaliate against you because you exercised your rights, except where permitted by law.

Retention

We retain personal information for as long as reasonably necessary to fulfill the purposes described in this notice and our Privacy Policy, including to provide the Service, manage accounts, process transactions, administer subscriptions and programs, operate Certified Coach Programs, maintain business records, comply with law, resolve disputes, prevent fraud, and enforce our agreements.
